A Deed in Lieu of Foreclosure for the Mortgage or Deed of Trust recorded on the property can be risky for the lender to accept since none of the junior matters are wiped out as occurs with a Foreclosure.

 

The Title received by the lender in a Deed in Lieu is the Title as it exists with all its faults as of the day of recording of the Deed.
